Sponsorship Contract Template

1. Parties

Influencer/athlete [NOME ATLETA], residing at [INDIRIZZO], and Brand [RAGIONE SOCIALE BRAND], registered at [INDIRIZZO], VAT [P.IVA BRAND].

2. Subject matter

The Brand acquires the right to place its logo on a spot on the Athlete's body chosen by the Athlete, via a temporary tattoo compliant with Regulation (EC) 1223/2009, to be applied during the race [NOME GARA], scheduled for [DATA].

3. Fee

A fee of €[IMPORTO] for winning the auction. Payment runs through escrow and is released to the Athlete after the race and delivery of the report referred to in clause 7.

4. Athlete obligations

  • Apply the tattoo during the specified race.
  • Publish at least [N] pieces of content labelled #ADV and tagging the Brand.
  • Not assign the same spot to anyone else for the same race.
  • Comply with the AGCOM guidelines on the recognisability of commercial communication.

5. Brand obligations

  • Provide the logo artwork in vector format within [N] days of signing.
  • Not request misleading or unlawful content.
  • Pay the fee within the agreed terms.

6. Indemnity

The Brand indemnifies the Athlete and BodyBid against any claim arising from content or trademarks supplied by the Brand, including third-party rights.

7. Post-race report

Within [N] days of the race the Athlete provides the report with available data on reach, impressions and interactions on the published content.

8. Intellectual property

The trademark remains the Brand's property. Content produced by the Athlete remains the Athlete's property, with a non-exclusive licence to the Brand for internal and commercial use.

9. Termination and cancelled races

If the race is cancelled, the escrowed fee is refunded to the Brand. If it is postponed, the parties may agree to carry the agreement over to the new date. In case of material breach, the compliant party may terminate with immediate effect.

10. Governing law and jurisdiction

The contract is governed by Italian law. Competent court: [FORO], subject to any mandatory rule of law.
